$362,500 in Negligent Truck Marking Case
In this very important case, our firm represented the passenger of a vehicle that struck the side of a tractor-trailer on a rural road in Wayne County, North Carolina just after nightfall. Initially, the insurance company for the tractor-trailer company made a very small offer to settle the case. The offer was so small that we felt it was best to file a lawsuit and challenge the positions of the insurance company.
Once in litigation, we forced the driver of the tractor-trailer to testify at a deposition. During this deposition, the tractor-trailer driver admitted that he had backed his trailer across the lane of travel of my client’s vehicle and that the position of his cab was such that it made it difficult for the driver of my client’s car to see the trailer.
During the litigation we were able to obtain pictures of the trailer which revealed very clear violations of the Federal Motor Carrier Safety Administration Regulations relating to conspicuity tape. The conspicuity tape on this trailer was worn out, dirty, and in many places not present at all. Our accident reconstructionist provided an opinion that the lack of visibility of the tape on the trailer along with the positioning of the cab made it impossible for the driver of my client’s car to see the trailer backed across the road. This case settled after an eight hour mediation.

In this important case, our firm represented the six children of a gentleman that was killed when a tractor-trailer turned into the path of my client who was riding his motorcycle near Lincolnton, North Carolina. Due to the collision, my client passed away at the scene.
